(2) Le titulaire d’un permis de rec

(2) Le titulaire d’un permis de recherche doit transmettre au Ministère un rapport annuel d’activités dont le contenu est précisé dans les textes d’application. Il en est de même en ce qui concerne le titulaire d’un permis d’exploitation ou d’une autorisation d’exploitation de carrière industrielle dans la mesure où celui-ci se livre à des activités de recherche dans le périmètre du permis d’exploitation.

(3) Tous les renseignements, documents et toute information obtenus par le Ministère et ses agents dans le déroulement de leur mission ou dans l’exécution des obligations du titulaire d’un permis de recherche, seront considérés comme strictement confidentiels, sauf indication contraire du titulaire, pendant la durée du titre dans la mesure où tout ou partie de celui-ci n’a pas été transformé en permis d’exploitation. Au delà de ce délai, les informations de caractère technique seront mises à la disposition du public.

En ce qui concerne les informations sur les travaux de recherche exécutés dans le cadre d’un permis d’exploitation ou d’une autorisation d’exploitation de carrière industrielle, leur confidentialité tombe avec la fin du permis d’exploitation et les informations de caractère technique sont en conséquence mises à la disposition du public.

Article 60 : Les travaux d’exploitation des mines et de carrières industrielles sont soumis au contrôle des services des administrations concernées dont les agents peuvent visiter à tout moment les chantiers d’exploitation, les haldes, les terrils, les résidus de traitement et toutes les installations indispensables aux travaux d’exploitation. Ceux-ci peuvent exiger la communication de documents de toute nature ainsi que la remise de tout échantillon nécessaire à l’accomplissement de leur mission. Les conditions de ce contrôle sont précisées par les textes d’application.

Toutes les informations recueillies par les services de ces administrations sont considérées comme strictement confidentielles et ne peuvent être rendues publiques ou communiquées à des tiers, à l’exception des informations concernant l’hygiène, la sécurité et l’environnement.

Article 61 : Tout titulaire est tenu d’appliquer les méthodes confirmées les plus aptes à obtenir le meilleur rendement final du gisement, compatible avec les conditions économiques locales et du marché et d’une façon générale d’exploiter suivant les règles de l’art, y compris celles relatives à la protection de l’environnement et au développement durable des ressources naturelles.

En cas de non-respect de cette obligation, le Ministère peut, après consultation et avis du Ministère chargé de l’Environnement pour les questions relatives à la protection de l’environnement et au développement durable, prescrire au titulaire toute mesure destinée à y remédier.

Article 62 : En vue de s’assurer que tout titulaire récupère la substance minérale économiquement exploitable qui fait l’objet de son activité en se conformant aux règles de l’art, le Ministère peut prendre les mesures appropriées telles que prescrites par les textes d’application.

Article 62: To ensure that a licensee recovers the economically exploitable mineral substance that is the subject of its activity in accordance with the rules of the art, the Department may take such appropriate measures as prescribed by the legislation.
