Chapitre VI : Des relations du titulaire d’une carrière avec le propriétaire du sol

Article 98 : Le droit de prospecter et d’exploiter des gîtes soumis au régime des carrières est défini à l’article 9 de la présente loi.

Article 99 : Le propriétaire du sol, qu’il soit public ou privé, optera, lorsqu’il est saisi d’une demande d’ouverture de carrière sur sa propriété, pour l’un des choix suivants :

1° Refuser la demande;
2° Vendre sa propriété au demandeur; ou
3° Louer sa propriété au demandeur.

Dans ce dernier cas, le demandeur peut exiger une durée de bail de dix (10) ans, renouvelable. A l’expiration du bail, le propriétaire peut s’opposer à son renouvellement. A la cessation du bail pour quelque raison que ce soit, le propriétaire est en droit d’exiger la remise en état du site. Toutefois, si cette cessation intervient par la faute du propriétaire, il doit une indemnité d’éviction au titulaire.


TITRE VIII : DES DÉCLARATIONS DE FOUILLES ET DE LEVES GEOPHYSIQUES ET GEOCHIMIQUES

Article 100 : Toute personne exécutant un sondage, un ouvrage souterrain, un travail de fouille à l’extérieur des périmètres miniers, quel qu’en soit l’objet, dont la profondeur dépasse dix (10) mètres au-dessous de la surface du sol, à l’exception toutefois des ouvrages de recherche ou de captage d’eau souterraine, dûment autorisés par le Ministère chargé de l’Hydraulique, doit être en mesure de justifier qu’une déclaration préalable en a été faite au Ministère.

Tout levé de mesures géophysiques au sol, toute campagne de prospection géochimique ou d’études de minéraux lourds doit faire l’objet d’une déclaration préalable au Ministère.

Article 101 : Les ingénieurs et techniciens du Ministère, dûment habilités à cet effet et munis d’un ordre de mission, ont accès à tout sondage, ouvrage souterrain ou travail de fouille soit pendant, soit après leur exécution, dés lors qu’ils dépassent dix (10) mètres de profondeur.

Article 102 : Les documents ou renseignements recueillis en application des articles 100 et 101 ci-dessus ne peuvent, sauf autorisation de l’auteur des travaux, être rendus publics ou communiqués à des tiers par le Ministère avant l’expiration d’un délai de trois (3) ans à compter de la date à laquelle ils ont été obtenus.

Pour les travaux exécutés en mer et par exception aux dispositions précitées, les renseignements intéressant la sécurité de la navigation de surface tombent immédiatement dans le domaine public.

Article 98: the right to prospect and exploit deposits subject to the regime of careers is defined in section 9 of this Act.

Article 99: the owner of the ground, whether public or private, optera, where it is seized with an application for opening of career on his property, for one of the following choices:

1 ° refuse the application;
2 ° sell his property to the applicant; or
3 ° rent its property to the applicant.

In the latter case, the applicant may require a renewable 10-year lease term. Upon expiry of the lease, the owner may object to its renewal. At the termination of the lease for any reason whatsoever, the owner is entitled to require the rehabilitation of the site. However, if such termination occurs by the fault of the owner, should compensation in the eviction to the holder.


Title VIII: of the statements of EXCAVATIONS and of surveys geophysical and GEOCHEMICAL

Article 100: anyone running a survey, an underground book,. search outside the mining perimeters work, regardless of the subject, the depth of which exceeds ten (10) metres below the surface of the soil, with the exception of the works of research or groundwater, duly authorized by the Ministry of hydraulics, must be able to justify that a prior statement was made to the Department.

Any survey, geophysical measurements on the ground, any campaign of geochemical and heavy mineral studies must make a prior declaration to the Ministry.

Article 101: engineers and technicians of the Department, duly empowered to this effect and equipped with a travel order,. have access to any survey, underground work or work to search either during or after their execution, therefore they exceed ten (10) metres deep.

Article 102: documents or information collected pursuant to articles 100 and 101 above cannot, unless authorized by the author of the work, be made public or disclosed to third parties by the Department before the expiry of a period of three (3) years from the date on which they were obtained.

For work performed at sea and as an exception to the above provisions, information relevant to the safety of navigation of surface immediately fall into the public domain.

The deposit as referred to in article 93 above will be released during the realization of the work of the rehabilitation or used by the competent authority for them to do something. Where the amount would be insufficient, additional funds will be required of the licensee.
For one of the following choices:

1° refuse the request;

Article 102: The documents or information obtained in application of articles 100 and 101 above may not, except with the permission of the author of the work,Be made public or disclosed to third parties by the Department before the expiration of a period of three (3) years from the date on which they have been obtained.

For the work carried out on sea and by exception to the above provisions, the information relevant to the safety of navigation of surface fall immediately into the public domain.
